Photography Agreement

PHOTOGRAPHY AGREEMENT:

This agreement is between the photographer - Lacy Rodgers DBA "Lacy Rodgers Photography," hereinafter referred to as "photographer," operating in the States of Kansas and Colorado and the signers of this agreement, hereinafter referred to as the "clients" or "client."

RETAINER/DEPOSIT:

A retaining deposit of 50% is required for booking of all sessions. This is a non-refundable retaining deposit. It shall be liquidated to cover photographer's time investment and booking slot in the event of a cancellation or breach of contract by the client. No date is reserved until a retaining deposit is received. The retainer shall be applied towards the total cost of the service to be rendered. The balance of the complete package price must be paid before or on the day of session. If full payment is not received, the photographer will not provide services and/or delivery of digital files or products. In the event of a necessary reschedule due to severe illness or injury, your retainer may be applied to any session taking place within 12 months of payment. If less than 12 hours of notice is given or client does not appear at their appointed session within 30 minutes of the agreed-upon starting time, the retainer is subject to be forfeited and the Photographer has the right to refuse rescheduling.

COPYRIGHT/USAGE

All photos are copyrighted. The negatives and/or digital images (hereinafter collectively the "images") created by the photographer remain the property of the photographer.

The client hereby understands the digital images and/or prints provided to them cannot be used for profit, commercial use or advertising. Usage shall be in accordance with the permissions within this agreement and outlined in the digital release provided to the client at the conclusion of paid services. The client may not authorize any reproductions by parties other than the photographer that are not indicated in the terms of said agreement/release.

CREATIVE LICENSE

Images are edited at the photographer's discretion, and delivered proofs will not include all images shot during a session. The photographer reserves the creative rights to edit and release only those images deemed creditable as professional in quality and within the photographer's artistic standards. Photographer also reserves the right to deny any request for additional editing or image files that are not explicitly indicated as being included with your purchased portrait session package.

Due to the nature of the digital images that are provided with your session, all sales are final and no refunds (partial nor full) shall be granted after the delivery of digital files via online gallery, USB, disk, or otherwise.

PRINT RELEASE

All session options/packages sold by Lacy Rodgers Photography include a print release allowing the client to print their images with the digital files delivered.

FAILURE TO PERFORM

If the photographer is unable to perform this agreement due to severe illness,emergency, fire, casualty, act of God or causes beyond the control of the photographer, the photographer will not be liable to return the deposit. If the photographer does not perform her duties for any reason otherwise, the photographer and client shall make every attempt to reschedule the session. If a reschedule is unable to be agreed upon, photographer shall return the retainer to the client and shall have no further liability. Further, if the photographer in unable to deliver photographic materials due to technological malfunctions, including but not limited to camera and processing, or otherwise lost or damaged without fault of the photographer, liability shall be limited to the session/package amount or a prorated total thereof.

INDEMNIFICATION:

The photographer shall be held harmless for any and all injury to the client during the course of the photography session and the immediate surrounding events.
